Welcome to ThrivingDaily. This Website and its associated services, assessments, and coaching services are operated by Thriving Daily Ltd, Company Number: 13931317, registered in England and Wales.

By accessing our Website, purchasing our digital products, or entering into an agreement, you agree to be bound by the following Terms & Conditions.

1. Eligibility & Agreement

By accessing this Website or purchasing any of our products, including but not limited to our digital products, you confirm that you are at least 18 years of age and possess the legal authority to enter into a binding financial contract. Furthermore, your use of our Website and services is governed by our Privacy Policy, which outlines how we collect, track, and process your personal data in strict accordance with UK GDPR.

2. Nature of Services & Medical Disclaimer

ThrivingDaily provides educational resources and behavioural assessments.

Not Medical Advice: Our services, including all diagnostic assessments and self-led library materials, are strictly strategic and educational in nature. They do not constitute, and are not a substitute for, licensed medical, psychological, psychiatric, or clinical therapy.

Client Responsibility: You are solely responsible for your physical and mental health, decisions, and actions. If you are experiencing a clinical mental health crisis, you must seek the help of a licensed medical professional.

3. Confidentiality & Privacy

Confidentiality & Discretion: We operate with the highest level of discretion. ThrivingDaily agrees to keep all personal, financial, and business information shared during our engagement strictly confidential. We will not disclose your identity or the nature of our work together without your prior written consent, unless explicitly compelled by a valid court order or under UK law.

Live Session Recordings & Replays: For internal quality assurance, service improvement, and training purposes, all live interactions with ThrivingDaily may be recorded. Occasionally, live group seminars or Q&A sessions may be recorded and made available exclusively for review within The Practice. By accessing these specific replays, you are bound by strict mutual confidentiality. You agree to keep any personal, financial, or business information shared by other participants completely private. Furthermore, these recordings fall under our strict Intellectual Property license; you are legally prohibited from downloading, screen-recording, distributing, transcribing or sharing these replays with any third party.

4. Newsletter Communications & Merit-Based Rewards

By subscribing to the ThrivingDaily newsletter, you consent to receive strategic insights, marketing communications, and promotional offers. You may unsubscribe at any time. We operate a merit-based reward system for consistent engagement. Subscribers who meet specific, verifiable criteria (such as logging consecutive weekly micro-actions) will automatically unlock complimentary, time-bound access to our digital resources, such as The Practice. These rewards are purely merit-based and do not involve chance. Any complimentary access granted has no cash equivalent, is strictly non-transferable, and will automatically expire at the end of the specified promotional period unless upgraded to a paid subscription. ThrivingDaily reserves the right to modify the criteria, suspend, or terminate this reward program at our sole discretion at any time without prior notice.

5. Standalone Products

Third-Party Distributors: For physical or digital books purchased via external distributors, all transactions, shipping, customer service, and returns are governed exclusively by the Terms & Conditions of that respective platform. ThrivingDaily does not process payments, manage fulfilment, or issue refunds for these third-party purchases.

Direct Digital Products: For any standalone digital products (such as PDF frameworks or audio trainings) purchased directly through the ThrivingDaily Website, delivery is immediate. By completing your purchase and initiating the download or access link, you expressly waive your 14-day right to cancel under UK Consumer Contracts Regulations. If you purchase a digital product but do not access it within 14 days, you may request a refund by emailing [email protected].

6. The Practice

For users enrolled in our self-led library:

Billing & Access: Depending on your selected enrolment plan (e.g., early adopter, lifetime access, or standard monthly), you will be billed either via a one-time fee or on a recurring basis to the payment method on file.

Cancellations: For recurring subscriptions, you may cancel your membership at any time to prevent future charges. Cancellations must be made at least 48 hours before your next scheduled billing date, by emailing [email protected].

No Refunds: Due to the immediate access to proprietary digital content, we do not offer pro-rated refunds for partially used subscription months. Upon cancellation, you will retain access until the end of your current billing cycle.

7. The Life Blueprint Assessment

The Life Blueprint Assessment is a proprietary digital diagnostic tool.

The Refund Policy: Under UK Consumer Contracts Regulations, you have a 14-day right to cancel a digital purchase — unless you access the content.

Voiding of Refund Rights: Due to the immediate and proprietary nature of this Assessment, your 14-day right to cancel is entirely waived the exact moment you click the access link or otherwise initiate digital access. Our internal tracking systems log the exact timestamp of this access. By purchasing, you expressly consent to this immediate delivery and acknowledge the permanent loss of your cancellation rights upon access.

Refunds Process: If you purchase the Assessment but do not click, access, or initiate the diagnostic within 14 days, you may request a full refund by emailing us at [email protected]. We will review our access logs within 5 business days. If no access has occurred, a refund will be initiated. Once initiated by us, the actual timing of the funds returning to your account is managed solely by our payment provider (Stripe) and your bank.

8. Intellectual Property & License to Access

All content provided by ThrivingDaily — including but not limited to the Life Blueprint Assessment, PDFs, frameworks, videos within The Practice library, and written materials — is the exclusive intellectual property of Thriving Daily Ltd.

When you purchase a product or subscription, you are granted a single-user, non-transferable, revocable License to Access the materials for your personal use.

You are strictly prohibited from scraping, downloading, recording, copying, reproducing, transcribing, or distributing any proprietary materials, videos, or frameworks to third parties. Violation of this clause will result in immediate termination of access without a refund and potential legal action.

9. Disclaimer of Guarantees

ThrivingDaily provides educational material and strategic frameworks. However, we make no guarantees regarding specific financial outcomes, career advancements, business growth, or personal results. Your success depends entirely on your own effort, execution, and external market factors. By engaging our services, you acknowledge that ThrivingDaily is not responsible for your individual or business outcomes.

10. Limitation of Liability

Certain liabilities cannot be legally limited or excluded under UK law, such as liability for fraud, fraudulent misrepresentation, or personal injury caused by negligence. Subject strictly to those statutory exceptions, Thriving Daily Ltd shall not be liable for any indirect, consequential, or special damages (including loss of profit, loss of business, or loss of data) arising out of your use of our Website, digital products, or services.

For all other actionable claims, including direct damages, our total aggregate liability to you shall in no event exceed the total amount you have paid to us for the specific product or service in dispute.

11. Third-Party Infrastructure

ThrivingDaily utilises secure, third-party software platforms to deliver our services, including but not limited to payment processors (e.g., Stripe), video conferencing tools, and digital hosting environments. While we partner strictly with industry-standard providers, Thriving Daily Ltd is not liable for any service interruptions, data breaches, or processing errors caused directly by these external platforms.

12. Force Majeure

Neither party shall be held liable for any delay or failure to perform their obligations under these terms if such delay or failure is caused by extreme, unforeseen events beyond reasonable control, including but not limited to severe medical emergencies, natural disasters, or major infrastructure failures. ThrivingDaily reserves the right to request reasonable documentation to verify such events. In the event of a true Force Majeure, the affected deliverable will not be refunded, but will be rescheduled or redelivered at the earliest mutual convenience.

Please note: This clause applies strictly to severe, unforeseen emergencies.

13. Payment Disputes & Chargebacks

By purchasing any service or product, including but not limited to physical or digital products or a subscription from ThrivingDaily, you explicitly agree to these Terms & Conditions and our strictly enforced refund policies. In the event of a financial disagreement, you agree to contact ThrivingDaily directly at [email protected] to seek a professional resolution.

If you initiate an invalid chargeback or payment dispute with your bank or credit card provider in an attempt to bypass these legally binding terms, we reserve the right to immediately terminate all access to our services and library without refund. Furthermore, you will be held legally and financially responsible for the original fee, plus any administrative, recovery, or legal costs incurred by Thriving Daily Ltd to recover the disputed funds.

14. Severability & Amendments

We reserve the right to update or modify these Terms & Conditions at any time. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

15. Governing Law & Jurisdiction

These Terms & Conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of this agreement.
